What New York's No-Fault Law Means for Your Case

New York is a no-fault state, which means your own auto insurance pays your initial medical bills and lost wages regardless of who caused the crash. But no-fault coverage has limits — and it doesn't compensate you for pain, suffering, or long-term losses.

To step outside the no-fault system and pursue a claim against the driver who caused your injuries, New York law requires you to meet what's called the "serious injury threshold." This threshold is defined by statute — not by how you feel the day after the accident.

Under New York Insurance Law § 5102(d), a serious injury includes:

  • Bone fracture
  • Significant limitation of use of a body function or system
  • Permanent consequential limitation of a body organ or member
  • A medically determined injury that prevents you from performing substantially all of your daily activities for at least 90 of the 180 days following the accident
  • Permanent loss of use of a body organ, member, function, or system
